1. Home Kitchen: Is someone who prepares Food at their own Home Kitchen.
2. Customer/Guest/Foodie: Is someone who wants Home Made Food from a desired Home Kitchen.

The Service is available in India by below mentioned company.

‘Foodizo Network Private Limited’ located in Pune, India.

The website & Mobile Apps are maintained by the above mentioned Entity.

In using our platforms, you are deemed to have read and agreed to the following terms & conditions. Please read them carefully. These Terms will be applied fully and affect your use of this platforms.

By using this platform, you agreed to accept all terms and conditions written in here. You must not use these platforms if you disagree with any of these Standard Terms and Conditions.

The following terminology applies to the Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. "The Company", “Ourselves”, “We” and "Us", refers to our Company- “Company Name”. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Your Content

In this Standard Terms and Conditions, "Your Content" shall mean any text, images, audio, video or other material you choose to display on this Website. By displaying Your Content, you grant Foodizo to use, reproduce, adapt, publish, translate and distribute it in any media.

Your Content must be your own and must not be invading any third-party’s rights. Foodizo reserves the right to remove any of Your Content from this Website at any time without notice.

Notes to Customers / Guests:

1. As a customer of our platforms, you agree to behave in an agreeable manner. Our kitchens will put every possible effort to make the entire experience memorable for you.

2. In case of any behavioural misconduct/other issues which cannot be sorted out mutually, please reach out to us (Refer ‘Contact Us’ Page).

3. During the entire process, if a kitchen is not comfortable hosting a particular order, the kitchen has rights to cancel the booking at any given point of time. The financial implication would be as per our Cancellation & Refund policy.

4. Any damage to property or person during the entire process will need to be mutually handled between the Customer and the Kitchen; Foodizo will not be held responsible or liable.

Notes to Kitchen Owners:

1. Kitchen owners are required to sign an E-Agreement copy with Foodizo.

2. You have the right to cancel an order if you are not comfortable serving it. The financial implication would be as per our Cancellation & Refund policy.

3. In case of any behavioural misconduct/other issues which cannot be sorted out mutually, please reach out to us (Refer ‘Contact Us’ Page).

4. You agree that Foodizo shall under no circumstance be held responsible or liable for a customer’s behaviour or other Issues not related to the Platforms.

5. Any damage to property or person during the entire process will need to be mutually handled between the customer and the kitchen; Foodizo will not be held responsible or liable.

Using our Services

You must follow any policies made available to you within the Services.

Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its Owners/Directors or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services.

The trademarks, names, logos and service marks (collectively “trademarks”) displayed on the Foodizo platforms are registered and unregistered trademarks of the Company. Nothing contained on the platforms should be construed as granting any license or right to use any trademark without the prior written permission of the Company.

Our Services display some content that may not have been put by our company. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do. In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

Liability for our Services

The platform's directors shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the platforms, any information contained on the platforms, your or your company’s personal information or material and information transmitted over our system. In particular, neither the platform owners nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury, Health related injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF 'FOODIZO’, FOR ANY CLAIM UNDER THESE TERMS, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES.

IN ALL CASES, ‘FOODIZO’ will NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Intellectual Property Rights

Other than the content you own, under these Terms, Foodizo and/or its licensors own all the intellectual property rights and materials contained in this Website. You are granted limited license only for purposes of viewing the material contained on this Website.

Restrictions

You are specifically restricted from all of the following:

- Publishing any Website material in any other media;

- Selling, sublicensing and/or otherwise commercializing any Website material;

- Publicly performing and/or showing any Website material;

- Using this platform in any way that is or may be damaging to this platforms;

- Using this platform in any way that impacts user access to this platforms;

- Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this platform;

- Using this platform to engage in any advertising or marketing.

Any user ID and password you may have for these platforms are confidential and you must maintain confidentiality as well.

Your Privacy

No warranties

This Platforms are provided "as is," with all faults, and ‘Foodizo’express no representations or warranties, of any kind related to this platform or the materials contained on this platform. Also, nothing contained on this platform shall be interpreted as advising you.

Limitation of liability

In no event shall ‘Foodizo’, nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this platorm whether such liability is under contract. ‘Foodizo’, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this platform.

Indemnification

You hereby indemnify to the fullest extent ‘Foodizo’ from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

Assignment

‘Foodizo’ is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of India. The Courts of law at Pune, Maharastra shall have exclusive jurisdiction over any disputes arising under this agreement.

YOU MUST COMMENCE ANY LEGAL ACTION AGAINST US WITHIN ONE (1) MONTH AFTER THE ALLEGED HARM INITIALLY OCCURS. FAILURE TO COMMENCE THE ACTION WITHIN THAT PERIOD SHALL FOREVER BAR ANY CLAIMS OR CAUSES OF ACTION REGARDING THE SAME FACTS OR OCCURRENCE, NOTWITHSTANDING ANY STATUTE OF LIMITATIONS OR OTHER LAW TO THE CONTRARY. WITHIN THIS PERIOD, ANY FAILURE BY US TO ENFORCE OR EXERCISE ANY PROVISION OF THESE TERMS OR ANY RELATED RIGHT SHALL NOT CONSTITUTE A WAIVER OF THAT RIGHT OR PROVISION.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. User is responsible for maintaining the confidentiality of his account. It will hold harmless and indemnify ‘Foodizo’ and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

Payment & transaction Policy

Foodizo is linked to multiple payment gateways to cater it’s wide range of users. Visa or Master Card debit and credit cards in INR will be accepted for payments. Card holders must retain a copy of the transaction record along with Foodizo’s policies and rules. Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt of payment. Please refer to our FAQ section for more details on the Payment Policy.

Copyright and other relevant intellectual property rights exist on all text relating to the Company’s services and the full content of this website.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Availability

The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service, you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.
